Fair Labor Standards Act (FLSA)

  • Federal law that establishes minimum wage, overtime pay, and youth employment standards
  • All UA positions have a default FLSA status (either exempt or non-exempt)

     

 

 

Non-exempt Employees (Hourly)

  • Paid at least the federal minimum wage
  • Paid overtime for all hours worked in excess of 40 hours per week (this includes all compensable hours where an employee is required or allowed to preform work including work preformed at home, travel time (except to and from work), waiting time, training, and probationary periods)
  • Submit time sheets for all hours worked

Exempt Employees (Salary)

  • Must meet the salary minimum ($684/week as of January 1, 2020)
  • Must pass the Department of Labor (DOL) Job Duties test
  • Not subject to receive overtime pay
  • Submit time sheets when reporting leave (this includes winter closure days between the observed Christmas and New Years holidays)
